The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 19.12.2013 (Annexure P-3) whereby his pension was stopped w.e.f. 30.03.2013 and order dated 19.07.2017 whereby his representation for restoration of pension was rejected.

Learned State counsel submits that State has already resorted provisional pension of the petitioner, thus, instant petition has rendered infructuous.

Learned counsel for the petitioner does not dispute the aforesaid statement, however, submits that petitioner may be granted liberty to avail remedies as permissible by law after adjudication of his appeal against conviction.
