Mr. Ayush Gupta, Advocate, for the petitioner --- TRIBHUVAN DAHIYA , J. (Oral) Learned counsel for the petitioner contends that the petitioner/ defendant No.1 is a widow, aged 73 years. Preliminary decree has been passed in the suit on 5.1.2016, however, final decree has not been passed so far, since the local commissioner's report is not forthcoming on record. Learned counsel further submits that every time the local commissioner goes for inspection, he is not able to carry out the same as the shops are found closed. The plea being taken is that the shops are in possession of Satish Kumar, plaintiff's son. In view of the aforesaid facts, especially because the petitioner/defendant no.1 being a senior citizen, the trial Court is directed to decide the civil suit expeditiously.
