Mr. Naresh Prabhakar, Advocate, for respondent No.6. **** Rajan Gupta, J. (Oral) Petitioner has sought a direction that it be permitted to raise a gate in the memory of Shaheed Baba Bir Singh Ji in village Saidpur, Block Sultanpur Lodhi, District Kapurthala. It has been urged before the court that necessary permission was granted by the PWD Department and construction was started. However, impugned letter dated 26.04.2016 (Annexure P-4) was received informing that part of the land is owned by the Forest Department. In view of the same, the construction has come to a stand still.

At this stage, learned State counsel submits that the matter can be examined by the Deputy Commissioner, Kapurthala, after perusing the record.

The petition is disposed of with the direction that Deputy Commissioner, Kapurthala, may afford an opportunity of hearing to the parties and take appropriate decision in the matter at the earliest, in any case, Sukhpreet Kaur 2017.11.18 14:16 I attest to the accuracy and integrity of this document
