By way of instant writ petition filed under Articles 226/227 of the Constitution of India, the petitioner has prayed for issuance of a writ in the nature of mandamus for directing respondent No.2 and his authorized representatives including respondent No.3 to take immediate steps to handover peaceful vacant possession of the mortgaged properties in terms of orders dated 22.04.2014, 02.05.2014 and 26.05.2014 (Annexures P-1 to P-3) passed by respondent No.2.

Written statement on behalf of respondents No.1 to 3 filed in Court today is taken on record subject to all just exceptions. Office to tag the same at appropriate place.

Mr. Subhash Sharma, AGM, Union Bank of India, has put in appearance on behalf of the Bank along with the counsel and produced a certificate dated 23.02.2017 stating that the possession of the properties in dispute have been handed over to the petitioner-bank. The said certificate is Ravinder Singh 2017.02.28 12:46 I attest to the accuracy and authenticity of this document taken on record.

In view of the above, learned counsel for the parties state that the writ petition has been rendered infructuous and may be disposed of as such. 5.
