         H.S. MADAAN , J. (Oral) earned counsel for the petitioner states that he be permitted to withdraw the present revision petition, since he intends to take recourse to the other remedy available to him under law. A perusal of the impugned order goes to show that the civil suit is pending for about 12 years. The defendants had closed their evidence on 08.01.2019 and case was fixed for 16.01.2019 for rebuttal evidence, if any otherwise for arguments and thereafter, 53 effective opportunities have been given to the plaintiff for the purpose of rebuttal evidence. This is a shocking state of affairs showing callous approach of the Court. Though counsel for the revisionist has sought withdrawal of the revision petition but a probe in the matter is required to be done as to how 53 opportunities had been granted for the purpose of rebuttal evidence. Let explanation of the Presiding Officer be obtained in that regard.

   directed to conduct an enquiry and inform this Court with regard to names of the Presiding Officers who have dealt with this case and the span of time for which they did so. Copies of the interim orders passed in the case be also sent to this Court along with report by District & Sessions Judge, within a fortnight. Learned District Judge would append his comments on the explanation by the Presiding Officer. The Presiding Officer of the trial Court is directed to dispose of the suit in question at the earliest possible, thereafter informing this Court in that regard. In view of the statement made by learned counsel for the petitioner recorded above, this revision petition is dismissed as withdrawn with liberty aforesaid. The enquiry report sent by District & Sessions Judge, Yamunanagar at Jagadhri be put up before this Court as and when it is received in the Registry.
