The present petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of writ in the nature of Mandamus for directing respondents No.2 and 3 to remove respondent No.5 from the post of Sarpanch as he is involved in criminal case. A further prayer has been made for directing respondents No.2 and 3 to take action on the applications dated 13.05.2024 and 07.06.2024 (Annexures P-1 and P-2 respectively) within some specified time.

Learned counsel for the petitioner submits that as regards the prayer made in the present petition, the petitioner has already submitted applications dated 13.05.2024 and 07.06.2024 (Annexures P-1 and P-2 respectively). Ms. Upasana Dhawan, AAG, Haryana, who has appeared on behalf of respondent/State in this case, pursuant to the advance copy of petition having been sent to the State, on instructions from Mr. Rajesh Tiwana, BDPO, submits that the aforesaid applications are already under consideration before the Deputy Commissioner, Nuh and an appropriate action would be taken thereon within a period of three months from today. 4.

In view of the statement made by learned State counsel, learned counsel for the petitioner submits that he does not press the instant petition any further.

In view of the aforesaid submissions made by the respective counsel, the petition is disposed of, accordingly. 6.
