Main case 1.
The present petition has been filed under Section 483 BNSS, 2023 seeking regular bail in case bearing FIR No.5 dated 10.09.2024, under Sections 420, 120-B IPC and Section 66-D of IT Act registered at Police Station Cyber Crime, District Pathankot.

The allegations against the petitioner are that, the petitioner provided his Account Number to his co-accused namely Zalaluddin so as to pass money taken from the complainant after playing a fraud upon the complainant amounting to Rs.79.27 lakh regarding dealership of Amuh Nut Medical Product.

Learned counsel for the petitioner contended that the petitioner is in custody since 03.05.2025 i.e. for the last more than 06 months. He further contended that investigation in the present case has already been completed. He also contended that the present petitioner is a student, aged about 20 years and is not involved in any criminal activity. He also drew the attention of this Court towards the account statement of the petitioner wherein the amount received in the account of the petitioner, has been transferred to some other account(s) on the same day itself.

! the petitioner intentionally provided his account details to the co-accused and received huge amount in lieu thereof and the complainant has been duped to the tune of Rs.79.27 lakh by the co-accused. # Heard.

Keeping in view the facts and circumstances of the present case and the allegation that the petitioner provided his account details to the coaccused through which huge amount has been transferred to some other account on the same date, approx. Rs.8 lakh was transferred in the account of the petitioner; investigation in the present case has already been completed; challan stands presented; out of total 15 prosecution witnesses, only 02 have been examined so far; keeping in view the fact the age of the petitioner and the fact that if he is kept in custody for longer time period, he will come in contact with hard core criminal(s) which resultantly, may demolish his future prospects; no useful purpose would be served by keeping
CRM-M-34410-2025 (O&M) -3him in custody for any further period; culpability is to be fixed after receiving evidence on behalf of both the parties during trial, this Court deems it a fit case to grant the concession of regular bail to the petitioner. 8.
Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. 9.
Nothing observed hereinabove shall be construed as an opinion on the merits of the main case.
