***** ARCHANA PURI, J. (Oral) The applicant/wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA396-2024 titled "Manish kumar v/s Vishakha", filed by the respondent/husband, which is pending in the courts at Ambala and she seeks transfer of the same to the court of competent jurisdiction at Family Court (Camp Court), Bilaspur, District Yamunanagar. Mr. Bhupender Singh, Advocate, has made appearance on behalf of respondent and filed Power of Attorney, which is taken on record. Counsel for the respondent submits that he has no objection, if the transfer application is allowed and the petition under Section 9 of Hindu Marriage Act, is transferred.
Heard.
It is submitted by the counsel for the applicant that the marriage between the parties was solemnized on 07.12.2021 and one son aged about 2 years, born from the said wedlock is presently in the care and custody of the Sonu 2025.02.19 19:06 I attest to the accuracy and authenticity of this document P&HHC
TA-908-2024 applicant. On account of matrimonial discord, the applicant has filed petition under Section 12 of the Domestic Violence Act, which is already pending in the courts at Bilaspur, District Yamunanagar. In view of the aforesaid fact situation and also considering the statement made by the counsel for the respondent, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA-396-2024 titled "Manish kumar v/s Vishakha", filed by the respondent/husband, stands transferred from the Family Court, Ambala, to the Court of competent jurisdiction at Bilaspur, District Yamunanagar. The requisite record of the aforesaid case be sent by the Family Court, Ambala, to the District and Sessions Judge, Yamunanagar. Learned District and Sessions Judge, Yamunanagar, shall assign the said petition to the Family Court (Camp Court), Bilaspur.
