The instant petition filed under Section 438 Cr.P.C. is the second attempt on the part of the petitioner seeking grant of anticipatory bail in respect of a case registered vide FIR No.52, dated 9.7.2022, Police Station Amir Khas, District Fazilka, Punjab, under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985, wherein offence under Section 29 of NDPS Act was added later on.

Learned counsel for the petitioner submitted that there has been a substantial change in circumstances after dismissal of the earlier bail application inasmuch as the petitioner recently lost his father on 25.8.2022. Learned counsel, in this regard, has referred to report (Annexure P-3) issued by Middha Multi Specialty Hospital, Jalalabad West, Punjab. 3.

On asking of the Court, Mr. Luvinder Sofat, DAG, Punjab, upon whom an advance copy of petition had already been served, accepts notice on behalf of the respondent-State.

Learned State counsel, upon instructions from Sub Inspector Ravi Pal, has informed that the father of the petitioner has indeed expired on 25.8.2022. 6.

Having heard the learned counsel for the petitioner and while noticing that the earlier petition seeking grant of anticipatory bail had been dismissed on merits, this Court does not deem appropriate to consider the merits of the petition again.

However, having regard to the fact that the petitioner's father has expired on 25.8.2022, this Court is of the opinion that the petitioner would be required to be with his family in this moment of grief and would be required to perform certain last rites.

The petition, as such, is disposed of with a direction to the petitioner to surrender before the Trial Court within a period of 3 days from today. Upon surrender of the petitioner before the Trial Court, the Trial Court shall release the petitioner on interim bail upto 30.9.2022 subject to his furnishing adequate bail bonds/surety bonds to its satisfaction. The Trial Court shall insist upon two sound heavy sureties. The petitioner immediately after furnishing bail bonds/surety bonds shall appear before the Investigating Officer and shall also appear subsequently as and when directed by the Investigating Officer.
