PARAMJEET SINGH DHALIWAL, J. (ORAL) Instant writ petition under Article 226 of the Constitution of India has been filed for issuance of a writ in the nature of mandamus directing the respondents to carry out the process of making revision in record of rights in terms of Section 32 of the Punjab Land Revenue Act, 1887 and prepare final records of rights in a time bound manner. I have heard learned counsel for the parties and perused the record.

Tehsildar, Ballabgarh, District Faridabad - respondent No.3 has filed his affidavit in Court today, same is taken on record. As per affidavit, vide memo No.3130/S.K. dated 22.03.2016 process for consolidation in the revenue estate of Village Makanpur has been RAVINDER SINGH 2016.04.01 16:46 I attest to the accuracy and authenticity of this document

-2CWP No.9168 of 2015 initiated but notification under Section 14(1) of the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948, has not been issued and the matter is pending before the Government. Even though the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act came into existence in the year 1948, consolidation has not been done in Village Makanpur till date and still old terms i.e. 'bighas' and 'biswas' are being used for the purpose of measurement of land. In almost entire State of Haryana new measurement terms in the shape of 'kanals' and 'marlas' are being used. Perhaps this is the only Village where terms 'bighas' and 'biswas' are being used for the purpose of measurement. In these circumstances, State is directed to issue notification under Section 14(1) of the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948 within a period of one month from the date of receipt of certified copy of this order.
