Jaswant Singh,J(Oral) Two petitioners i.e. Smt.Sushma Rani and Smt.Anju Khera were appointed as Social Studies Mistresses on 2.9.2001 with the Department of Education(Schools)Punjab pursuant to their selections on 13.12.1996 as appointments of such teachers were delayed due to pending litigation.

Prayer now made is for fixation of their notional pay w.e.f. 1.1.1997 as has been fixed in the case of Mohinder Singh,Master and Smt.Nirdosh Kumari. The basis for seeking such relief is that they were selected in the same selection and thus entitled to same treatment. After hearing the learned counsel for the petitioners, no case for interference is made out.

It is apparent from the record that the pay of Smt.Nirdosh Kumari and Mohinder Singh were notionally fixed w.e.f. back dates on account of teachers juniors to them in merit having been appointed earlier. CWP 9173/2015 In the present case, it is a conceded position that both the petitioners have their joint seniority only with Smt.Nirdosh Kumari, who concededly is senior to both the petitioners. As regards, Mohinder Singh, his seniority is in male cadre and has no connection with the seniority of petitioners. Thus, no parallel and benefit can be drawn on the basis as canvassed. In view of the above, finding no merit in the present petition the same is dismissed with costs of Rs.5000/- each (Rupees five thousand each) to be deposited by the petitioners with District Legal Service Authority concerned within two months from the receipt of a copy of this order.
