The petitioner through the instant petition filed under Articles 226/227 of the Constitution of India, has prayed for issuance of a writ in the nature of Mandamus directing the respondents to decide the legal notice dated 3.11.2014 (Annexure P-7) and to get the mutation sanctioned in his favour from the revenue authorities as the petitioner is allottee of a plot measuring 309.94 square yards and sale deed has been executed by the respondents on 21.3.1974 in his favour. 2.

The petitioner was allotted plot No. 24-A measuring 309.94 square yards situated in Shashtri Nagar, Ludhiana vide sale deed dated 21.3.1974 (Annexure P-1). He constructed a residential house thereon. The petitioner approached the revenue authorities for sanction of mutation of the said plot/house in his favour who refused to do the same no land against khasra Nos. 78//20/1 and 78//20/3 was left in their favour. CWP No. 9199 of 2015 -2- (Annexure P-6) to respondent No.3 for execution of Tartima sale deed of the plot in question in his favour. Since no action was taken on the application, the petitioner sent a legal notice dated 3.11.2014 (Annexure P-7) to respondents No.2 and 3, but no response has been received till date. Hence, the present writ petition.

Learned counsel for the petitioner submitted that for the relief claimed in the writ petition, the petitioner has sent a legal notice dated 3.11.2014 (Annexure P-7) to respondents No.2 and 3, but no action has so far been taken thereon.

After hearing learned counsel for the petitioner, perusing the present petition and without expressing any opinion on the merits of the case, we dispose of the present petition by directing respondent No.2 to take a decision on the legal notice dated 3.11.2014 (Annexure P-7), in accordance with law by passing a speaking order and after affording an opportunity of hearing to the petitioner within a period of three months from the date of receipt of certified copy of the order.
