Both the authorities have concurrently held that the instrument was not registered under the Charitable Endowments Act, 1890, rather the same was registered under the provisions of Indian Registration Act, where the relief in question was not available to the petitioner. On 28.09.2022, learned counsel for the petitioner sought an adjournment in order to show that the instrument was registered under the Charitable Endowments Act, 1890. None has come to represent the petitioner.

Dismissed for non-prosecution.
