******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.248 dated 01.05.2019 registered for offences punishable under Sections 506, 447, 427, 379 and 120-B of Indian Penal Code (for short, "IPC") at Police Station Suraj Kund, District Faridabad. (Offences punishable under Sections 454 and 380 IPC were added later on). Heard.

Notice of motion.

On asking of the Court, Mr. Munish Sharma, AAG Haryana, who is present in the Court accepts notice and submits that intimation by Registry informing of fixation of the petition has already been received and record of the case is available with him.

As per case of prosecution, complainant-Bank had auctioned the property mortgaged with it by one Rishu Suri to secure loan of `1,40,00,000/-. CRM-M-34906-2019 -2gate of the property and dismantling the shed using gas cutters. He informed the Bank and police. On arriving at the spot, Bank officials found the shed at the spot missing. The back wall of the property had been broken and some people were erecting walls in the plot. Petitioner alongwith some other persons was present there.

Learned State counsel submits that the petitioner and other persons, who were present at the spot, have taken away the shed, material lying there and tried to grab the bank property. The petitioner was arrested on 31.07.2019. The matter is still under investigation and other accused are yet to be arrested.

At this stage, learned counsel for the petitioner seeks permission to withdraw the instant petition.

Dismissed as withdrawn.
