Present revision petition has been filed under Article 227 of the Constitution of India challenging order dated 11.07.2024 whereby the application filed by the petitioner under Section 10 of the Code of Civil Procedure, 1908 was dismissed.

On 07.08.2024 the following order was passed : "Notice of motion only to explore the possibility of consolidating both the suits, returnable 29.08.2024. Dasti as well. Liberty to serve the respondents through counsel representing them before the Court concerned. To be shown in the urgent list."

Mr. Nitin Sachdeva, Advocate has put in appearance on behalf of contesting respondent No.1 and has filed his power of attorney, which is taken on record. He states that respondent No.1 would have no objection if both the suits are consolidated/tried and heard together. In view of the statement made by learned counsel for respondent No.1, the present revision petition is disposed off with a direction that both the suits i.e. CS/6324/2020 and CS/808/2021 pending before the Civil Judge (Junior Division), Ludhiana be consolidated/tried and heard together in accordance with law. Pending applications, if any, also stand disposed off. The District Judge, Ludhiana is requested to allocate both the suits to the same Court.
