**** ANOOP CHITKARA, J. (ORAL) CRM-M-40857-2022 In paragraph 11 of the petition, the petitioner mentioned that he has no criminal history.

Counsel for the petitioner submits that he did not draft the present petition and the defect has come because of mis-communication with the earlier counsel by the family members of the petitioner. He further submits that there is a criminal history and he be permitted to withdraw the present petition with liberty to file fresh petition before the concerned Sessions Court because the co-accused was granted bail by the Sessions Court. Given above, the present petition stands disposed of having been withdrawn with liberty aforesaid. All pending miscellaneous applications, if any, stand disposed of. It is clarified that reasons for which the Sessions Court had dismissed the earlier bail petition shall not be considered while deciding the fresh petition and it will be considered afresh including parity.

Liberty is reserved to the petitioner to come to this Court again, if need arises.
