(Oral) This petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 522 dated 26.11.2019, under Sections 365/376-D/342/506 of IPC and Section 4 of POCSO Act, registered at Police Station Sampla, District Rohtak.
Learned counsel for the petitioner submits that the girl has refused her medical examination on 27.11.2019, as per her statement (P-5). She got herself examined on 29.11.2019 after 02 days of the incident. Learned counsel states that the victim, her father and her mother have turned hostile.
Learned State counsel on instructions submits that out of 20 witnesses, 03 have been examined and the next date is 07.12.2021. Learned State counsel admits that the victim, her father and her mother have turned hostile.

CRM No. M-45506 of 2021 -2The petitioner is in custody since 06.12.2019 Keeping in view the COVID 19 situation and the fact that trial will take some time for its conclusion, this court feels that there is no need to detain the petitioner any longer. Accordingly, this petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of concerned Chief Judicial Magistrate/Duty Magistrate.
