By way of this petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the petitioner seeks quashing of FIR No.75 dated 13.04.2018 under Sections 13(1)(d)(iii) of Prevention of Corruption Act, 1988 and Section 72 of IT Act, 2000 and Section 120-B IPC, 1860 (Charge framed under Section 72-A of IT Act, 2000 only ) registered at Police Station City Kharar, District SAS Nagar, Mohali alongwith all consequential proceedings arising therefrom on the basis of compromise dated 16.06.2025 (Annexure P-3).

CRM-M-34829-2025(O&M) -2factum of the compromise having been effected between the parties and states that respondent No.2 has no objection to the quashing of FIR in question. 5.
Learned State counsel has stated no objection in case the FIR is quashed based upon the compromise. He further states that the petitioner is not involved in any other case.

I have heard learned counsel for the parties and perused the material placed on record.

In view of the above, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences, therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 9.
Accordingly, the petition is allowed and FIR No.75 dated 13.04.2018 under Sections 13(1)(d)(iii) of Prevention of Corruption Act, 1988 and Section 72 of IT Act, 2000 and Section 120-B IPC, 1860 (Charge framed under Section 72-A of IT Act, 2000 only ) registered at Police Station City Kharar, District SAS Nagar, Mohali alongwith all consequential proceedings arising therefrom are quashed qua the petitioner.

Needless to say that the parties shall remain bound by the terms of compromise.
