Petitioner seeks quashing of order dated 26.11.2025 of learned Additional District & Sessions Judge, Amritsar vide which his bail bonds/surety bonds were cancelled and forfeited to the State, in case arising out of FIR No. 23 dated 05.03.2023 under Sections 379-B Indian Penal Code, Police Station Kathu Nangal, District Amritsar Rural.

Learned counsel for the petitioner submits that petitioner was addicted to intoxicants and after release on bail vide order dated 14.03.2024, he absented from the Court of learned Additional Sessions Judge, Amritsar on 23.04.2024, whereupon his bail was cancelled and bonds were forfeited to the state. Non-bailable warrants were being issued against the petitioner to procure his presence. He further submits that petitioner remained admitted in 'Umeed Foundation', Drug Counselling and Rehabilitation Centre from 18.05.2025 to 17.07.2025, again from 26.12.2025 to 02.03.2026 and 14.04.2026 to 27.05.2026 AJAY GOSWAMI 2026.07.01 18:21 I attest to the accuracy and integrity of this document

Learned counsel further submits that absence of the petitioner was on account his drug addiction and he was ready to put in appearance before learned trial Court on each and every date of hearing and take the trial to its logical end. 3.
Notice of motion.

Mr. Kunwarbir Singh, AAG Punjab, who is present in the Court, accepts notice on behalf of respondent-State and supports the order of learned Additional Sessions Judge, Amritsar. He prays for dismissal of the petition. 5.
Petitioner, who was facing trial before the Court of learned Additional Sessions Judge, Amritsar, absented on 23.04.2024. His bail order was cancelled, bail bonds and surety bonds furnished were also cancelled and forfeited to State. Although there is no apparent illegality in the impugned order, bona fide intention of the petitioner is to face trial. He is accordingly directed to surrender before learned trial Court within 15 days and move an application for regular bail before learned Additional Sessions Judge, Amritsar, which learned trial Court shall decide expeditiously and also initiate proceedings under Section 446 Cr.P.C. Till then, non-bailable warrants issued against the petitioner, shall be kept in abeyance. 6.
Petition is disposed of on the aforesaid terms. 7.
