Learned counsel for the State submits that investigation is complete and challan stands presented on 06.09.2021. At this stage, learned counsel for the petitioner submits that he be permitted to withdraw the present petition with liberty to raise the non-arraigning of all the accused persons in the challan and unnecessarily giving up some under section 169 Cr.P.C. and also for deletion of 307 IPC. Given above, the petition is disposed of as having been withdrawn with liberty reserve to raise all the findings at the time of framing of charges. However, it shall be open for the petitioner to file an application under 319 Cr.P.C. or any appropriate provision before the trial Court and the trial Court shall decide the same on top most priority.
