RAJIVE BHALLA, J. (ORAL) A dispute, in the present case, relates to custody of a minor child. The trial court has allowed custody of the minor to the respondent. During pendency of the appeal, parties have, in proceedings arising from a divorce petition, resolved their differences and filed a petition under Section 13-B of the Hindu Marriage Act, 1955 (hereinafter referred to as "the Act") for dissolution of marriage by mutual consent.

Counsel for the parties agree that as controversy, in the present appeal, has also been settled, in settlement recorded in the petition, filed under Section 13-B of the Act, the present petition has been rendered infructuous and may be disposed of accordingly but with liberty to seek revival in case the settlement breaks down.
