Prayer made in the writ petition is for issuance of directions to the respondents to grant compassionate allowance to the petitioner as mentioned in Rule 41 of the Central Civil Services (Pension) Rules, 1972. Learned counsel for the petitioner contended that case of the petitioner is squarely covered as per the ratio of judgment rendered by the Hon'ble Apex Court in Mahinder Dutt Sharma v. Union of India and Others (2014) 11 Supreme Court Cases 684. Learned counsel further contended that petitioner made representation dated 11.04.2018 (Annexure P4) in this regard, which is pending with the authorities and the same has not been decided so far. Learned counsel submitted that grievance of the petitioner would be redressed if his representation (Annexure P4) is decided in the light of the judgment rendered by the Hon'ble Apex Court in Mahinder Dutt Sharma's case (supra).
