This is a Civil Writ Petition under Article 226/227 of the Constitution of India for issuance of an appropriate writ, order or direction especially in the nature of certiorari setting aside the Gram Panchayat resolution dated 16.04.2026 (Annexure P-5).

Learned counsel appearing for respondents no.1 to 5 has raised preliminary objection and has submitted that the petitioner has an alternate remedy under Section 47 of the Haryana Panchayati Raj Act, 1994 to challenge the resolution dated 16.04.2026 (Annexure P-5) in case the petitioner is aggrieved with the same.

Learned counsel for the petitioner has submitted that in view of DAVINDER KUMAR 2026.07.02 09:43 I attest the accuracy and authenticity of this order / judgment

CWP-19032-2026(O&M) 2 the above objection, the petitioner be permitted to withdraw the present writ petition with liberty to avail the alternate remedy in accordance with law. 4.

In view of the above, the present writ petition is dismissed as withdrawn with the aforesaid liberty.

It is made clear that this Court has not opined on the said alternate remedy which the petitioner wishes to institute and in case any such alternate remedy is availed, then, the case be decided after hearing both the parties concerned.
