(Oral) The precise grievance of the petitioner in brief is that he was appointed as District Data Manager under NRHM on 07.103.2013 (P-4) and her contract was renewed from time to time till 31.03.2016 (P-5 to P-6) and thereafter, his name was recommended again for renewal on 14.03.2016 on the ground that he performed his duties honestly and timely (P-7). The post of District Data Manger has been sanctioned for the year 2016+-17 (P-8) but the contract of the petitioner has not been renewed. The petitioner has not been allowed to join w.e.f April, 2016 which shows he has been relieved. CWP No. 8463 of 2016 -2Learned counsel for the petitioner states, that at this stage, the petitioners will be satisfied, if directions are issued to respondents to decide the complaint/representation, referred to above. Petitioner is seeking benefit of continuation of his services on contract basis till regular incumbents join, in view of the judgment of Hon'ble the Supreme Court of India in a case of Hargurpratap Singh vs. State of Punjab and others, 2007 (13) SCC 292 In view of above, without commenting on the merits of the case, this petition is disposed of with a direction to the respondents to decide the complaint/representation dated 17.04.2016 (P-9) of the petitioner by passing a speaking order expeditiously, in accordance with law. Till the decision on the representation of the petitioner, he should not be replaced by any other contractual employee.
