Aina Mehta v. Central Board Of Secondary Education And ORS.
In the High Court of Punjab and Haryana, at Chandigarh Civil Writ Petition No. 9329 of 2015 Date of Decision: 24.09.2015 Aina Mehta (minor) ... Petitioner(s)
Versus
Central Board of Secondary Education and Others ... Respondent(s)
CORAM:
Hon'ble Mr. Justice G.S.Sandhawalia.
Present:
Mr. Jitender K. Sehrawat, Advocate for the petitioner(s).
Mr. N.K.Setia, Advocate for the respondents.
G.S.Sandhawalia, J.
The present petition has been filed for correction of the father's name of the petitioner from D.N.Mehta to Daya Nand Mehta in the matriculation certificate (Annexure P1) dated 30.5.2013. The said request was forwarded by the school on 15.9.2014 and the defence of the Board is that it had to be approached within one year as per Rule 69.1 amended vide notification dated 25.6.2015. Admittedly, the petitioner had approached the respondents on 16.9.2014 before the amendment and at that point of time, the requirement was that the petitioner would approach the Board within a period of two years from the date of declaration of the result and the request was within the prescribed period. Civil Writ Petition No. 9329 of 2015 action of the Board in not acting on the demand is without any basis. It is also a matter of fact that the petitioner's father's name has also been corrected in the admit card of 10+2.
In such circumstances, the present petition is disposed of with a direction to the respondent-Board to take action on the representation and do the needful within a period of two months from the date of receipt of a certified copy of this order. (G.S.Sandhawalia) Judge September 24, 2015 "DK"
