Petitioner Manpreet Singh has filed petition under Section 438 of Cr.P.C. for grant of anticipatory bail in FIR No.33 dated 10.05.2024, under Section 21 and 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 (added later on vide DDR No.69 dated 16.05.2024), registered at Police Station GRP Amritsar, District Amritsar. 2.

As per facts of the case, on 10.05.2024, ASI Kashmir Singh and police party apprehended one person at 21:00 Hrs. on the basis of suspicion, who disclosed his name as Jatinder Kumar. His search was conducted as per rules and from his possession ice/powder like narcotic substance in a polythene bag weight 100 gm was recovered. On the basis of this recovery, present FIR was registered. Present petitioner was named in the disclosure statement of Jatinder Kumar.

Learned counsel for petitioner argued that arrest of petitioner was stayed vide order dated 05.08.2024 and he has already joined the investigation. No recovery is effected from him. He is ready to abide by the terms of bail order. Therefore, his anticipatory bail petition may be allowed. 4.

I have considered the aforesaid arguments and have gone through the record. It is not disputed that present petitioner has joined investigation. 2#3 0( (#&#  3(. Therefore, no purpose would be served by sending the petitioner behind the bars. Accordingly, anticipatory bail petition filed by petitioner -Manpreet Singh is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 438(2) Cr.P.C. 6.

Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
