(ORAL) In the present writ petition, the petitioners are the retired employees, who are claiming step up of their pay under the instructions issued by the Government of Haryana dated 23.11.2009. It has been contended by the counsel for the petitioners that all the petitioners are general category candidates, who could not be promoted and their junior Smt.Angoori Devi was promoted by giving her reservation as she belongs to the reserved category before the petitioners were promoted. Now upon catching her on the promotional post, the petitioners were entitled for the grant of step up of pay as being given to Smt. Angoori Devi in view of the instructions dated 23.11.2009. CWP-27937-2018 -2Counsel for the petitioners states that their case is covered by the judgment of this Court passed in CWP No.9918 of 2013 titled 'Jaswant Singh and others Vs. State of Haryana and others', decided on 01.05.2015.

In respect of the claim made in the present writ petition the petitioners have served a legal notice upon the respondents on 04.06.2018 (Annexure P-6).

Counsel for the petitioners states that the petitioners will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the legal notice dated 04.06.2018 (Annexure P-6) by passing a speaking order.

In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioners, the respondents are directed to decide the legal notice dated 04.06.2018 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners are entitled for any monetary benefit, the same shall also be released to them within a period of next three months.

Present writ petition stands disposed of.
