Learned counsel for the petitioner submits that though initially the petitioner was appointed as Beldar in the year 1990 but after the petitioner was inducted into the service, since 1998 the petitioner was discharging the duty of the post of Perokar. Learned counsel submits that though the petitioner discharged the duties of the post of Perokar but the petitioner was not given the salary of the said post and even after the petitioner retired from service, he was being treated as a Beldar hence, the petitioner has suffered prejudice not only during the service but even after his retirement in respect of grant of the pensionary benefits. Learned counsel for the petitioner submits that the grievance which is being raised in the petition, has already been brought to the notice of the respondents vide the representation dated 29.04.

2020 (Annexure P.9) and legal notice dated 13.06.2022 (Annexure P.10), copies of which have been attached as Annexures P.9 and P.10 and the petitioner will be satisfied in case a direction is issued to the respondent No.2 to decide the same by passing an appropriate speaking order in a time bound manner. On the asking of the Court, Mr. Harish Nain, learned Assistant Advocate General, Haryana, who is present in Court, accepts notice on behalf of the respondents- State and raises no objection in deciding the representation dated 29.04.2020 (Annexure P.9) and legal notice dated 13.06.2022 (Annexure P.10) in a time bound manner by passing an appropriate speaking order.

In view of the pleadings in the present petition, without expressing any opinion on the merits of the case or the claim being made by the petitioners in the representation, respondent No.2 is directed to decide the representation dated 29.04.2020 (Annexure P.9) and legal notice dated 13.06.2022 (Annexure P.10), by passing a speaking order within a period of eight weeks from the date of receipt of copy of this order. Present writ petition stands disposed of.
