The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to issue passport.

The petitioner was issued passport on 16.10.2002 which was valid upto 15.10.2012. The petitioner was involved in three FIRs. The petitioner stands acquitted in FIR No.240 dated 22.10.2008, under Sections 392, 506, 120-B of IPC and Section 13 (1) (d) read with Section 13 (2) of Prevention of Corruption Act, registered at Police Station City Kotkapura. The petitioner was convicted in FIR No.149 dated 15.10.2008, under Sections 395, 506, 120-B of IPC and Section 13 (1) (d) read with Section 13 (2) of Prevention of Corruption Act, at Police Station Jaito, District Faridkot and FIR No.239 dated 20.10.2008, under Sections 392, 506, 120B of IPC and Section 13 (1) (d) read with Section 13 (2) of Prevention of Corruption Act, registered at Police Station Jaito, District Faridkot. CWP-17465-2023 -22023:PHHC:123004 petitioner has preferred appeals against aforesaid judgments of conviction. This Court vide order dated 16.01.2013 (Annexure P-1) and 16.04.2015 (Annexure P-2) respectively has suspended the sentence. 3.

Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others, 2023 SCC Online (P&H) 1391. He further submits that the petitioner would leave country after seeking prior approval of this court i.e. Appellate Court. 4.

Learned counsel for the respondent-UOI submits that the competent authority would pass an appropriate order within 06 weeks after considering the judgment of this Court in Mohan Lal @ Mohna's case (supra).

In the wake of statement of learned counsels for the parties, the petition stands disposed of.
