Mr. K.S. Hissowal, Advocate for the petitioner. RAKESH KUMAR JAIN, J (ORAL) Learned counsel for the petitioner has submitted that before passing the order under Section 200 of the Punjab Panchayati Raj Act, 1994, notice was not given to the petitioner.
From the reading of the impugned order, it is found that notice was given to the members of the Panchayat including the Sarpanch on 05.9.2017 and thereafter when no reply was received, opportunity of hearing was also given vide notice dated 29.9.2017. Ultimately, it was found that the Panchayat is not performing its duty and therefore the Administrator has been appointed.
Thus, I do not find merit in this petition and the same is hereby dismissed.
