Present petition has been filed for quashing of the notification dated 24.05.2016 published in the Haryana Gazette dated 14.06.2016 (Annexure P-1) issued under Section 11(i) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Learned senior counsel appearing on behalf of the petitioners has contended that post notification dated 24.05.2016 published in the Haryana Gazette dated 14.06.2016 (Annexure P-1), no award has been passed. Learned senior counsel has further pointed out to the reply filed by the respondents wherein the following stand has been taken :

CWP-17433-2023 -2- "11. That the contents of Para No. 11 of the petition are admitted to the extent that no award is announced. It is submitted that the Haryana Government issued new policy for purchase the land voluntarily offered for development projects is already attached as AnnexureR1. Hence the land is being purchased through this policy instead the Right to Fair Compensation and Transparency in land Acquisition, Rehabilitation and Resettlement Act, 2013. Therefore no award was announced the act 2013.

12. That the contents of Para No. 12 of petition are a reproduction of the provisions of the Act 2013. It is submitted that the Haryana Government issued new policy for purchase the land voluntarily offered for development projects is already attached as AnnexureR1. Hence the land is being purchased through this policy instead the Right to Fair Compensation and Transparency in land Acquisition, Rehabilitation and Resettlement Act, 2013."

Learned State counsel is not in a position to deny the fact that till date neither any award has been passed in the present case nor the petitioners have opted to sell their land under the Policy (Annexure R-1). Hence, the land has neither been acquired nor purchased by the State under the Policy. 4.

In view of the specific stand taken by the respondent-State that no further proceedings have been initiated post the notification (Annexure P-1) and that the land has neither been acquired nor purchased by the State

CWP-17433-2023 -3under the Policy, no further orders are required to be passed in the present case and the same stands disposed off. Pending applications, if any, also stand disposed off.
