The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of orders whereby he was dismissed from service and higher authorities upheld his dismissal from service.

Learned counsel for the petitioner submits that petitioner was dismissed from service on account of his conviction in a private complaint under Section 498A IPC. He preferred an appeal before Appellate Court which dismissed his appeal. He preferred revision before this Court which was allowed vide judgment dated 05.01.2024. 3.

In view of judgment of this Court, the petitioner approached respondent who reinstated him in service. The respondent has reinstated him without backwages.

The petitioner stands reinstated in view of judgment of acquittal. The judgment of acquittal was passed during the pendency of instant petition and he was reinstated on the basis of said judgment. 5.

In the backdrop, the instant petition has rendered infructuous.

Dismissed as having been rendered infructuous. The petitioner is at liberty to avail remedies as permissible by law with respect to his claim for backwages.
