A complaint under Section 138 of the Negotiable Instruments Act was filed by respondent No.1 against the present petitioner in which summoning order was passed on 15.04.2024. Despite service through registered post, he failed to appear and then bailable warrants of arrest were issued against him. Ultimately proclamation under Section 82 of Cr.P.C was issued and based on the report thereon, the petitioner was declared proclaimed person vide order dated 25.05.2026 (Annexure P-11). Now the matter is fixed before the learned Trial Court for 18.07.2026 for initiating proceedings under Section 83 Cr.P.C. 2.
It is contended by learned counsel for the petitioner that the petitioner was not served; that he has been wrongly declared a proclaimed person as 30 days mandatory period was not granted to him. He has further referred to Annexure P-12, as per which the proclamation was issued on 15.04.2026 for 24.04.2026. Learned counsel further submits that the petitioner is ready to surrender before the Court.

Having noted the contentions of learned counsel for the petitioner, the present petition is hereby disposed of with a direction to the petitioner to surrender before the learned Trial Court concerned on or before 18.07.2026, the date already fixed there. On his appearance, he shall be admitted to bail to the satisfaction of the learned trial Court. If in the meantime, the petitioner is arrested in view of he having been declared a proclaimed person, he shall be admitted to interim bail by the Arresting Officer. 4.
