 Through the instant petition, the petitioner seeks regular bail in case bearing FIR No.42 dated 27.03.2021, registered under Section 22(c) of the NDPS Act, at Police Station Jaitu, District Faridkot. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case and that the petitioner has been in custody since 27.03.2021.

Per contra, while opposing the prayer for grant of regular bail to the petitioner, learned State counsel does not dispute the custody period of the petitioner. He, however, submits that the petitioner is a habitual offender, inasmuch as, six more FIRs of similar nature, have been registered and/or pending against her. Out of the said cases, the petitioner stands convicted in four cases, acquitted in one and the remaining one is under trial. He further submits that the recovery effected from the petitioner, falls under commercial quantity. AMAN JAIN 2022.07.06 17:16 I attest to the accuracy and authenticity of this order/judgment

CRM-M-45205-2021 (O&M) -2I have heard the learned counsel for the parties. As noticed above, there are six more cases registered and/or pending against the petitioner. Though in one case she stands acquitted, yet the fact remains that she is a person with criminal antecedents. Thus, keeping in view the fact that the petitioner is a habitual offender having brazen criminal antecedents, she does not deserve the concession of the regular bail. Moreover, the nature of the offences committed by the petitioner is sufficient enough to hold that if released on bail, she would again involve herself in similar crime. Further, the recovery effected from the petitioner is of a commercial quantity.

In view of the above, no ground is made out to grant regular bail to the petitioner.

Dismissed.
