**** RITU BAHRI , J. (Oral) Petitioner was appointed as Peon vide appointment letter dated 27.06.2000 under ex gratia scheme and he joined on 01.08.2000. The petitioner passed his matriculation examination in the year 2011 and submitted certificate to the Board but the date of birth of the petitioner was found to be wrongly stated in the matriculation certificate. The petitioner corrected the same and the matriculation was submitted in the office of Board on 08.03.2013. The respondent-department issued seniority list of class IV employees on 27.12.2013 but the name of the petitioner was not added in the seniority list at appropriate place. In view of the above seniority list, the persons junior to the petitioner were promoted to the post of Clerk on 27.06.2017. The petitioner then made a complaint on 11.089.2017 to respondent No.

2 and in the proceedings dated 14.09.2017 and final order dated 15.09.2017, it was admitted that the petitioner should have been promoted from the date his juniors were promoted but till date no Gaurav Arora 2018.11.

CWP No. 28085 -2018 action has been taken. The petitioner gave a legal notice dated 05.09.2018 (Annexure P-6).

In view of the above factual position, this petition, at this stage is being disposed of without expressing any opinion on the merits of the case, by giving a direction to respondent No. 3 to consider the case of the petitioner by passing a speaking order on the legal notice dated 05.09.2018 (Annexure P-6) filed by the petitioners, in accordance with law. This exercise shall be completed within a period of four months' from the date of receipt of certified copy of this order.
