(ORAL) The jurisdiction of this Court under Section 438 of the Code of Criminal Procedure, 1973 has been invoked for the grant of anticipatory bail to the petitioner in case FIR No.208, dated 17.07.2023, under Sections 327, 323, 294, 506, 120-B, 384 of the Indian Penal Code, 1860, registered at Police Station Zirakpur, District SAS Nagar, Mohali. Learned counsel for the petitioner submits that in pursuance to the orders dated 10.08.2023, the petitioner has joined investigation. This very fact is not controverted by learned State counsel who, on instructions from ASI Jai Pal Singh, submits that the petitioner is not required for custodial interrogation as nothing is to be recovered from him. Accordingly, the present petition is allowed and the interim order dated 10.08.2023 is made absolute. However, the petitioner shall continue to join investigation as and when required to do so and shall abide by the terms and conditions, as laid down under Section 438 (2) Cr.P.C.
