Raj Kumar @ Raj Sarvi And ORS v. State Of Punjab And Others
In The High Court for the States of Punjab and Haryana At Chandigarh CRM-M-41483-2020 (O&M) Date of Decision:-10.12.2020 Raj Kumar @ Raj Sarvi and others ... Petitioners
Versus
State of Punjab and others ... Respondents
CORAM:
HON'BLE MR. JUSTICE GURVINDER SINGH GILL Present:- Mr. Sandeep Arora, Advocate for the petitioners. (proceedings conducted through video conferencing) ***** GURVINDER SINGH GILL, J.(Oral) Learned counsel for the petitioners contends that respondent No.4-Neelam Kumari Rattu had earlier i.e. about 5 years back made a complaint against the petitioners alleging therein that petitioner No.1-Raj Kumar @ Raj Sarvi, while holding a false promise of marriage, had established physical relations with her. It is contended that said complaint was duly enquired into and the same was consigned as no action was warranted as would be evident from the report dated 02.06.2015 (Annexure P-1).
It has been submitted that respondent No.4 has now again made identical allegations in a fresh complaint addressed to the Commissioner of Police, Jalandhar (Annexure P-2) so as to unnecessarily harass the petitioners.

It is further directed that in case any of the petitioners is required to be associated with any fresh enquiry or any information is to be elicited, then a prior notice be issued to them before summoning them.
The petition stands disposed of accordingly.
