(Oral) Petitioner has impugned order dated 17.05.2018, Annexure P-3, passed by respondent No.1-Deputy Commissioner, Hoshiarpur while exercising powers under the provisions of the Act. According to him, order is non-speaking in nature. The application filed by the petitioner has been dismissed on the sole ground that the property is ancestral in nature. According to him, nothing has come on record in support of this finding. He, thus, prays that the matter be remitted to the same authority for a decision afresh. This prayer is not opposed by learned counsel appearing for the respondents.
In view of the above, impugned order, Annexure P-3, is hereby set aside and the matter is remitted to the same authority for a decision afresh as per law. The authority shall endeavour to conclude the proceedings at the earliest, in any case, not later than three months. Allowed in these terms.
