Present petition has been filed under Section 482 of the Bhartiya Nagarik Suraksha Sanihta 2023 (hereinafter referred as BNSS) by the petitioners seeking anticipatory bail in case bearing FIR No. 93 dated 11.05.2026 (Annexure P-1), registered under Sections 303(2), 115(2), 117(2), 118(1), 118(2), 191(3) and 190 of the Bhartiya Nayaya Sanihta 2023 (hereinafter referred as BNS) corresponding to Sections 379, 323, 324, 325, 326, 148 and 149 of the IPC respectively at Police Station Sadar Batala, Police District Batala, District Gurdaspur.

Learned counsel for the petitioners submits that they have been falsely implicated in the present case. It is contended that only simple injuries have been attributed to the petitioners and that their alleged involvement does not attract the provisions of Sections 191(3) and 190 of the BNS. Status report has been filed by learned Additional Advocate General, Punjab, in the Court today. As per the status report, both the petitioners have been attributed simple blunt injuries allegedly caused by a dang (wooden stick).

Liability of petitioners under Sections 191(3) and 190 of the BNS, is a matter to be determined during trial upon appreciation of evidence. Keeping in view the nature of allegations, the attribution against the petitioners and the fact that only simple injuries have been attributed to them, the petitioners are ordered to be released on anticipatory bail in the event of their arrest, subject to their furnishing bail bonds in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the Investigating Officer/SHO concerned and subject to compliance with the conditions envisaged under Section 482(2) of the BNSS.

The petition stands disposed of accordingly.
