The petitioners by way of this petition have prayed for quashing the order dated 26.06.2023 (Annexure P-1), whereby, the petitioner has been appointed as a Nodal Officer of Court cases and therefore, some other person has been posted in his place as Panchayat Secretary. 2.

Learned counsel for the petitioner submits that the petitioner has old parents to take care of and has no knowledge about the court cases and therefore, he should not have been posted as Nodal Officer of Court cases and more so, there is no such post in the Department. 3.

I have considered the submission.

The post of the petitioner remains intact as Village Development Organizer (VDO) and he continues to draw salary on the said post. The work of Nodal Officer of Court cases is the field of duties assigned to the petitioner which in ordinary course, he should not refuse. CWP-17427-2023 -2- 2023:PHHC:104189 would always be free to take appropriate decision/action but no right can be said to have been taken away of the petitioner. The State Government and the Panchayat Authority have all administrative rights to take work from their employees as per their requirement.
