(ORAL) In view of paras No.4 and 5 of the short reply filed by way of affidavit of Manoranjan Sharma, officiating Secretary, District Red Cross Society, District-Rewari on behalf of the respondents, the petitioner is entitled for gratuity and leave encashment as per Rule 15. For contributory Provident Fund, the petitioner is entitled as per rules applicable in case of Haryana Government employees. For payment of earned leave and gratuity, the respondent-society is facing acute shortage of funds and even wages are not being paid to the employees from POONAM BHATT 2023.04.24 17:40 I attest to the accuracy and integrity of this document

2023:PHHC:056637 CWP No.22146 of 2021 -2June, 2022 to August, 2022. GPF amount has already been released on 14.02.2022 and other benefits i.e. gratuity and leave encashment shall be released shortly without any further delay.

Learned counsel for the respondent No.2 submits that the financial condition of the respondent-society is writ large on the record of the case and some time be given to pay the dues of the petitioner towards gratuity and leave encashment. Learned counsel for the respondent-society assures the Court that needful in the context of releasing the amount towards gratuity and leave encashment of the petitioner will be done within a period of 2 months from today.

In view of the aforesaid, this writ petition is disposed of.
