(ORAL) Petitions herein, inter alia, are for issuance of a writ in the nature of Mandamus directing respondents No.1 and 4 to include the subject of Environmental Science as a mandatory requisite qualification for all positions in the Department of Environment. By exclusion thereof, B.Sc/M.Sc/M.E./M.Tech Environment Science/Engineering has been omitted as an essential subject in the (computerized) application for the post of SSA (Senior Scientific Assistant) as well as JSA (Junior Scientific Assistant).

While issuing notice on 06.05.2016 in CWP No.8726 of 2016, following order was passed by my learned sister Ritu Bahri, J. (as she then was seized of the matter):

"Learned counsel for the petitioners, inter alia, contends that vide advertisement dated 04.02.2016 (Annexure P-1), recruitment is being made in the Department of Environment for the post of Senior Scientific Assistant (SSA) as well as Junior Scientific Assistant (JSA). However, prescribing the qualification of eligibility, M.Sc./M.E./M.Tech Environment Science has been omitted. The petitioners, who have applied for the said posts being suitable have been made ineligible.

Notice of motion for 01.06.2016.

In the meantime, the respondents shall accept the applications of the petitioners provisionally, subject to final decision of this petition."

Apropos, petitioners' applications were entertained on provisional basis. On a Court query, the learned counsel for the petitioners, for lack of instructions, is unable to assist as to what had happened after the applications were entertained on provisional basis. It transpires that after the aforesaid interim order was passed the petitioners seem to have lost interest in pursuing the writ petition. Candidatures of the petitioners were also entertained pursuant to the aforesaid order. Entire selection process is stated to be now over. 4.

Petitions are accordingly disposed of as infructuous. 5.

Pending civil miscellaneous application, if any, also stands disposed of.
