MANJARI NEHRU KAUL , J. (ORAL) The petitioner is seeking issuance of direction to the Arresting/Investigating Officer to release the petitioner on bail in the event of his arrest as due to his non-appearance before the learned Additional Sessions Judge, Chandigarh, on 14.07.2023 in Criminal Appeal No.9/2023 titled as 'Navneet Singla Versus Monika Rehal', wherein the said Court has ordered issuance of warrants of arrest against the petitioner in an appeal filed against the order dated 05.12.2022 passed in Complaint No.NACT 15271/2018 dated 25.07.2018 under Section 138 of the Negotiable Instruments Act, 1881. 2.

Learned counsel for the petitioner at the outset submits that the petitioner is ready and willing to appear and surrender before the lower Appellate Court. Hence, in the aforementioned facts and circumstances, petitioner be protected till his appearance before the said Court and with directions to the trial Court that his bail application, which he would be filing on his surrender, be decided on the same day. 3.

In view of the limited prayer made by the learned counsel for the petitioner, the instant petition is disposed of with directions to the petitioner to appear and surrender before the lower Appellate Court within seven days from today. Till then, no coercive steps be taken against the petitioner.

It is made clear that in case, the petitioner fails to surrender before the said Court within seven days from today, this order shall be of no avail to him. In case, on appearance and surrender, the petitioner moves an application for bail before the said Court, the same shall be decided expeditiously preferably within 02 days, by the said Court in accordance with law.
