JASWANT SINGH, J. (ORAL) Petitioner is serving as Chief Pharmacist, Grade-2 and vide order dated 6.8.2018, (P1) was transferred from Primary Health Centre, Jandwala, Bhimshah, District Fazilka, to Civil Hospital, Abohar, Fazilka, in place of Prem Nath - respondent No.5, who was promoted to the post of Chief Pharmacist, Grade-I, and transferred to Civil Hospital, Fazilka. The grievance of the petitioner is that inspite of four months having elapsed, the transfer order qua the petitioner has not been implemented.

CWP-28167-2018 (O&M) On the previous date of hearing, Ms.Anu Chatrath Kapoor, Addl. A.G. Punjab, was directed to verify the facts. At the time of resumed hearing, learned State counsel, on instructions of Mr.Banwari Lal, Jr. Asstt. Civil Hospital, Abohar, states that respondent No.5 - Prem Nath, has foregone his promotion to the post of Chief Pharmacist, Grade-I and thus, the place to which the petitioner was transferred never fell vacant. It is for this reason the transfer of the petitioner was deemed to be cancelled.
In view of aforesaid circumstances, no grounds exist for invoking the writ jurisdiction, as such, the instant writ petition is dismissed. (JASWANT SINGH) JUDGE November 13, 2018.
