ARUN MONGA, J. (ORAL) Present petition has been filed under Section 438 of Code of Criminal Procedure, 1973 (for short 'Cr. P.C.') for grant of anticipatory bail to the petitioner in FIR No.25 dated 30.01.2020 registered under Sections 406, 420 of IPC, Section 13 of Punjab Travel Professionals (Regulation) Act, 2014 and Section 24 of Immigration Act, Police Station City Nawanshahar, District S.B.S. Nagar.

Learned counsel for the petitioner submits that pursuant to earlier order dated 28.10.2021 passed by this Court, petitioner has joined the investigation and has fully cooperated in the same. 3.
Learned State counsel submits that per his instructions from ASI Gurdev Singh, petitioner has joined investigation and in view of cooperation rendered by him, no custodial interrogation of petitioner is required. However, he further submits that petition for quashing of impugned FIR on the basis of compromise had already been withdrawn by the petitioner. 3.1 On the last date of hearing, learned counsel for petitioner had sought time to apprise this Court about the status of compromise effected between the parties. On resumed hearing today, learned counsel informs that matter has been compromised and all the outstanding dues have been paid to complainant-Davinder Singh Darmrait before learned trial Court, vide Demand Draft No.435649 dated 20.07.2023 for a sum of Rs.5 lakh, copy of which has been placed on record in the course of hearing. 3.2 None has appeared on behalf of complainant which is suggestive of the fact that complainant has no objection to the present petition being allowed.

Be that as it may, in view of the above, since custodial interrogation of petitioner is no more required and he has already joined investigation and cooperated with the investigating officer, present petition is allowed. Order dated 28.10.2021 granting interim anticipatory bail to the petitioner is made absolute, subject to petitioner's complying with provisions under Section 438(2) Cr.P.C.
