Tribhuvan Dahiya, J (Oral) The petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to consider the petitioner's claim for the post of PGT English in response to advertisement no.1/2012. 2.

Learned State counsel, on instructions received from Secretary of the Commission vide Memo dated 09.09.2024, contends that final result of selection was declared on 30.12.2013, and candidates against all the 187 posts advertised for BC category were recommended. No post is lying vacant as per the result. The petitioner could not be recommended for appointment as he secured 44.42 marks (25.42 for academic qualification and 19 for Interview), whereas the last selected candidate in BC category secured 53.18 marks.

Learned counsel for the petitioner is not in a position to dispute the facts aforementioned.

In view thereof, the petitioner's claim for being considered for the post in question cannot be entertained, since he was not recommended for selection being lower in merit.
