Prayer made in the writ petition is for issuance of directions to the respondents to release the cash security amount i.e. Rs.74,000/- which was deposited by the petitioner during the period of his employment and for release of arrears of gratuity and leave encashment which have not been released to him without any justified grounds, though he retired from services on 31.08.2009. As per the response of the respondents, the amount was not released to the petitioner as some audit report for the year 2004-05 is still pending.

Learned counsel for the petitioner contended that as petitioner retired long back and security amount and retiral benefit have not been released to him without any justified grounds and as per judgment rendered by this Court in Tara Chand Sharma v. Civil Writ Petition No. 28237 of 2018 deducted from the retiral benefits. Learned counsel further contended that detailed submissions of the petitioner by way of legal notices dated 31.10.2017 (Annexure P3) and dated 22.05.2018 (Annexure P7), respectively, are pending with the respondents for decision. In view of above, present writ petition stands disposed of with the directions to the respondents to look into legal notices dated 31.10.2017 (Annexure P3) and dated 22.05.2018 (Annexure P7)) and take the required decision thereon, expeditiously and preferably within a period of three months from the date of receipt of a certified copy of this order.
