**** AJAY KUMAR MITTAL, J. (Oral) Learned counsel for the petitioners states that the application under Section 28A of the Land Acquisition Act, 1894 (in short 'the Act') filed before respondent No.3 within limitation was decided by respondent No.3 vide order dated 22nd March, 2005, on the basis of which the award was announced on 22nd March, 2005 (Annexure P-2). 2.
It was urged by the learned counsel for the petitioners that inadvertently a prayer has been incorporated seeking direction to respondent No.3 to decide the application filed by the petitioners under Section 28A of the Act. It was submitted by the learned counsel for the petitioners that appropriate and specific prayers could not be incorporated in the writ petition. Accordingly, a prayer was made that he may be allowed to withdraw the present writ petition with liberty to the petitioners to file a fresh petition on the same cause of action by furnishing better and correct particulars and also by incorporating specific prayers.
