RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for quashing of impugned order, dated 11.09.2018, Annexure P-3, passed by respondent No.1 dismissing appeal of the petitioner being wrong, unjust and improper and further to set aside the order dated 27.02.2018, Annexure P-1, passed by respondent No.2 vide which respondent No.3 has been appointed as Lambardar of the village Sulchani, Tehsil Narnaund, District Hisar, illegally, arbitrarily and against the Rules. It is further prayed to direct respondent No.2 to appoint the petitioner as Lambardar of village being meritorious candidate as well as having hereditary claim under the provisions of Lambardari Rules.

CWP-28318-2018 -2Learned counsel for the petitioner fairly states that he may be allowed to withdraw the present petition with liberty to the petitioner to avail the remedy of approaching the learned Financial Commissioner. Allowed as prayed for.

Petition is dismissed as withdrawn with liberty aforesaid. It is made clear that if issue regarding limitation arises, then learned Financial Commissioner would decide the same by considering the period spent before this Court by the petitioner in pursuing this petition as per Section 14 of the Limitation Act.
