Present petition under Section 438 Cr.P.C. for granting prearrest bail to the petitioner in case FIR No. 242 dated 03.08.2017 registered under Sections 18, 21 & 61 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Pinjore, District Panchkula. Learned counsel for the petitioner contended that petitioner was admitted to regular bail on 27.09.2017; he had been regularly appearing before the learned trial Court for a period of two years; his bail was cancelled on account of his non-appearance on 22.07.2019; even on that date, he moved an application for seeking his exemption from personal appearance, which was dismissed by the learned trial Judge and non-bailable warrants of arrested were ordered to be issued against him. Learned counsel further contended that petitioner has no reason or ground to misuse the concession of bail bail and he is ready to surrender before the learned trial Court and to furnish fresh bail bonds and surety bonds. On asking of the Court, Mr. Ashish Sanghi, Deputy Advocate General, Haryana accepts notice on behalf of the respondent. A complete copy of paper-book be provided to him during the course of the day. In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to regular bail, the learned trial Judge shall release him on regular bail on his furnishing fresh bail bonds and surety bonds. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner.
